A Brief Introduction About the Martial Contract

A marital contract is a contract used mostly for the commercial purpose where the martial arts club uses a document to reserve a place for learners. The documents include the time period, rules, and regulations along with the tuition fee. Once this document is signed, it guaranteed that the student guarantees to pay the mentioned amount whether they attend the martial arts class or not.

The martial contract can be for a period of one, two more years. These types of contracts come mainly from the fitness industry, gyms because, with the help of such contracts, the clients are retained, and there is a regular flow of income (McClellan & Anderson, 2002). If any student is not attending the martial arts classes but has signed up a contract with the martial arts school, then it’s mandatory for them to pay the mentioned amount.

On the other hand, if they wish to cancel the contract due to some reason, then they have to pay the penalty amount in the form of the cancellation fee. Contracts solve the problem for the club management because then the management does not need to rely on the monthly payment. Chasing the members of the martial art club is a tedious task, so its best for them to get the contract signed by the members.

Who Takes the Martial Contract?

The people involved in the marital contract are martial art school management or the club management and the members of the club and students (Macarie & Roberts, 2010). If it’s a fitness center, then the people involved are the salespeople and members of the gym.

Purpose of the Martial Contract

The purpose of the martial contract is to ensure that the parties involved will abide by the rules and regulations mentioned in the contract (Corder, 1999). Once the contract is signed, it forced the people to learn martial arts as they have already signed the contract. Once both the parties agree to the terms & conditions and they are ready to join the classes after paying the amount, then the contract is signed.

Contents of the Martial Contract – Inclusions

The contents of the martial contract include: –

  • Name – The names of both the parties involved will be clearly mentioned on the top of the agreement.
  • Date – The term period of the contract, start and end date will be mentioned.
  • Member details – The age of the member, medical conditions, phone number, the address will be included
  • Waiver and release – After the details of the member, the waiver statement is written, which should be read and signed by the member. This section basically includes acceptance of the terms and conditions of the martial art contract.
  • Signature – Once all the above steps are completed, the signature of the member of he/she is above 21 should be there, and if not, then parents or guardians’ signature should be there.   

How to Draft the Martial Contract?

To draft the agreement correctly, the following steps will be taken: –

  • The first step while drafting the martial art agreement is to mention the details of the member joining the classes along with the contract term period.
  • The second step includes the monthly membership details like a family package, couple package, student package, etc. (Macarie & Roberts, 2010).
  • The third step while drafting this agreement is to include the accessories and gear required for martial art training. If the student wishes to take the gear from the training center itself, then he/she needs to sign, or else leave the column blank if not interested in taking.
  • The last section is for office use only, which includes start date, payment details, etc.

Benefits & Drawbacks of the Martial Contract

Benefits

Martial arts contracts encourage people to come in for classes regularly and adopt a fit and healthy lifestyle. If there is no contract and just regular classes, then the members will not come for the classes regularly and make some or the other excuse to drop the classes. So when a person signs a contract and joins the classes then they learn to be more disciplined, they obtain self-control qualities, balance, speed, there is higher flexibility and positivity in life. (Macarie & Roberts, 2010).

Drawbacks

One major drawback of martial art contracts is that it binds the person in a contract because of which the person has to pay regardless of whether they attend classes or not. Even if they want to cancel the contract then also, they need to pay the cancellation fee. Secondly, this contract forces the person to learn martial art once the contract is signed, even if the person is not interested to learn.

What Happens In Case Of Violation?

In case of violation or cancellation of the martial contract(1), the penalty is imposed, which is the remaining amount of the contract (Macarie & Roberts, 2010). The party that is canceling the contract will have to pay this amount to the other party in the form of the cancelation fee. If the cancellation fee is not paid, then there is legal action taken against the party.

To conclude, the martial art contract is a contract that binds the person to attend the classes once the payment for the classes is made. The term period of this contract can be one, two, or more years. This contract has both – benefits and drawbacks because it encourages a person to learn martial arts and be fit and healthy, but it also binds them to pay whether they go for class or not.
