Artist Selection and Planning: This is the creative process of booking your line up. It includes profile line-up’s, getting ideas through music outlets and networks.

Incoming pitches: This will require seeking to find specialists in the genre and actively using data from record labels, finding out how sales were the last time the band played, how long ago it was, what the streaming numbers are, whether they will be releasing new music, whether the band has been in the media lately or won an award, etc.

Budget: includes what the artist would charge, that is a performance fee, but there are other artist-related costs that you are required to factor into your budget.

Artist requirement:  Many artists have personal requirements that would be listed in an artist rider as part of your contract with the artist.

How to Draft the Artist Booking Contract?

  • Rights of the Agent: This permits the Agent to know what they may or may not conduct and what is expected in return from the Artist.
  • Compensation of the Agent: This lets the Agent know the particular monetary sum he would be paid and when he would be paid. It contains the details on compensation and the percentage of all earnings the agent shall receive.
  • Expenses: This allows the Agent to know what he shall be reimbursed for in accordance with the services he is providing towards the Artist.
  • Duration and Term: This part states how long the contract would run and if and how it could be extended.
  • Authority: This specifies what the Agent has the authority to execute for the Artist.
  • Definitions: This specifies various terms that are contained within the contract.
  • Independent Activities: this lets the Agent render the Artist services to anyone else as agreed upon by the Artist.
  • Exclusivity: The Artist agrees not to involve any other person to act within the capacity that the Agent was contracted for.
  • Assignment: this state for the transfer of the agreement to other parties as necessary.
  • Breach and Cure: If the contract is violated the terms for a cure are set forth in this area.
  • Legal Representation: The Artist acknowledges his right for lawful representation.
  • Notices: Gives the address where all notices and payments should be sent for both the Agent and the Artist.
  • Jurisdiction: This states where this agreement has been executed. The laws of this State would apply to this contract.

In an artist booking contract, most artists shall quote a specific fee for a performance, but it may be up for negotiation. One must include details about any artist development support you could offer. Once you have reached an agreement with the artist’s booking agent, make sure you put everything in writing.

What Happens in Case of Violation?

In case an Artist has canceled the show(1), the Client might pursue legal action against the Artist. The Artist is required to pay the Agent the equivalent of the Clients’ booking deposit in 7 days as a penalty fee. Also, the Artist should reimburse the Client for cost differences between the fee for their performance and any substitute artist arranged through the Agent or Client. If the Client has canceled the booking, cancellation fees would be applicable.

When the cancellation fees are not paid within the stipulated days the Artist and/or the Agent might take legal action and might refer the sum to a debt recovery company.

In an artist booking contract, the Artist agrees towards employing the Agent to book performances for the Artist. The client here means the individual or company who wishes to hire the Artist through the Agent to perform at their Event.
