Arbitration Agreement

The Arbitration Agreement is a type of written contract wherein both the parties involved agree to settle their dispute outside the courts. The Arbitration Agreement is normally considered to be a clause of a larger contract. The two parties signing an Arbitration Agreement contract are referred to as the Plaintiff and the Defendant. The proceedings are overseen by an Arbitrator chosen by the court.

Terms and Conditions:

  1. The arbitrator(s), while acting in the official capacity of court-appointed arbitrator in this matter, shall have the same immunity from liability accorded to United States district judges while acting in their official capacity.
  2. Either party shall agree that the result of the arbitration will be final and binding.
  3. Both party and their counsel, under the guidance of the arbitrator, should agree on facts presented in accordance to the Arbitration Agreement in order to maximize the value of the arbitration hearing and to reach a result.
  4. Each party will designate its primary and secondary witnesses no later than: 11/10/2011 (Month/Date/Year).
  5. The names of the witnesses will be exchanged between the two parties no later than: : 11/10/2011(Month/Date/Year).

The hearing on the arbitration has been scheduled for the 15th day of November (Month), 2011 at 10:00 am in Room #12 of Florida High Court. Each Party will have 2 hours within which they have to present their evidence and make their argument, unless the time is extended by the arbitrator.
